How Does My Bankruptcy Hearing Look Now?

In the post-COVID word your bankruptcy 341 hearing may look a little different than it has in the past. Most of the bankruptcy 341 hearings are still being conducted remotely. This means you will need to either connect via a Zoom link or you will receive a phone number and passcode to use when you call in.

For Zoom, the Trustee will provide us with the link prior to your 341. Our office staff will notify you of the time, date, and provide the Zoom link. In order to connect via Zoom you will need to ensure that you have a strong internet connection so that you are able to have a clear video and audio connection. If you are unsure on how to work Zoom please contact our office and we will be able to help you. At the time for your 341 you will connect to Zoom via the link provided. You will want to make sure that your video connection is on, and you are muted when you login. When your case is called by the Trustee you will unmute yourself and your 341 hearing will begin. When you are finished answering the Trustee’s questions you will be able to disconnect and leave the meeting.

For a phone 341 hearing, the Trustee will provide us with the phone number and a passcode prior to your 341. You will dial the phone number from your phone and then when prompted to, you will input the additional passcode you were provided. Once that is verified you will be let into the waiting room. You will want to make sure and mute yourself during the other hearings. When your case is called by the Trustee you will unmute yourself and your 341 hearing will begin. When you are finished with your hearing you will be able to hangup.

It is important to remember that a virtual 341 hearing is still a court hearing. You will still be sworn in and put under oath when you answer the Trustee’s questions. It is important to attend your virtual 341 hearing from a place with a strong internet connection, so your device is able to connect you to your hearing. You will need to ensure you are in a quiet place with no background interference so that the Trustee can hear your answers clearly and without interference.
